The cleaning hatch of the blender was open, exposing the rotating blade and as the worker started using the machine, three fingers and a thumb on his right hand were amputated.

The Health and Safety Executive (HSE) prosecuted Smith Weston Ltd of Elveden Road, Park Royal, which employed the worker. HSE also prosecuted Kolak Snack Foods Ltd, which owned the site – and which supplies many major supermarkets with their products – following the incident on 27 April 2009.

The City of London Magistrates Court heard that the machine should have stopped automatically when the cleaning hatch was open, and that the blender was in a poor state of repair.

Kolak Snack Foods Ltd should have had properly planned safe systems of work at the site and maintained the machinery so workers could not have access to dangerous parts, while the machine was in motion. Staff should have also been suitably trained and supervised.

Smith Weston Ltd pleaded guilty to breaching section 2(1) of the Health and Safety at Work etc Act 1974. The company was fined £7,500 ($11,300).

Kolak Snack Foods Ltd, which was responsible for maintence of the machinery, pleaded guilty to breaching section 3(1) of the Health and Safety at Work etc Act 1974. The company was fined £7,500 ($11,300).

Both companies were jointly ordered to pay costs of £3,365 ($5,100).

Following the hearing, HSE Inspector, Saif Deen said:

“This worker suffered horrific and lifelong injuries to his right hand, because these companies failed to properly protect him.

This case stresses the need for employers to have safe systems of work in place so that guards and crucial safety devices are working properly, ensuring that dangerous machinery can be used safely.”

The employee was pulled into a 14-foot-high metal-shaping machine when his overalls became entangled. He was working at ADA Machining Services Ltd on Kayley Industrial Estate, Richmond Street, on 2 January 2008.

The 53-year-old from Manchester, who has asked not to be named, lost one finger on his right hand and badly injured another. He suffered a dozen broken ribs, a cracked breast bone and friction burns to the left hand side of his body.

A Health and Safety Executive (HSE) investigation found the company had failed to comply with a health and safety law requiring it to prevent access to any dangerous parts of machinery.

ADA Machining pleaded guilty to breaching relevant UK regulations (Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998). The company was ordered to pay £6,220 towards the costs of the prosecution in addition to the fine at Manchester Crown Court on 22 June 2010.

David Norton, the investigating inspector for HSE, said:

“One of ADA’s employees suffered devastating injuries and is still unable to return to work, more than two years after he was trapped in the machine.

It’s vital that companies take action to protect employees who are required to operate potentially dangerous machinery. Otherwise workers will continue to be injured in the future.

The company knew that rotating parts in the machinery were potentially dangerous. If it had installed guard on the machine, as the law requires, it would have prevented someone being seriously injured.”

There were 32 deaths and more than 22,000 serious injuries in the manufacturing sector in Great Britain last year.

Directive 2007/47/EC enhances the criteria for the conformity assessment of medical devices and strengthens the procedures for such assessment. The Directive aims on the one hand to ensure a high level of protection of human health and safety and on the other hand to ensure that medical devices can circulate freely throughout the Single Market (thereby offering manufacturers economies of scale and users greater choice). Member States were obliged to notify the Commission of measures taken to implement Directive 2007/47/EC by December 21, 2008, but Estonia has so far failed to do so.

This standard deals with the emission of radiation from machinery. This European Standard gives advice to manufacturers for the construction of safe machinery, if no relevant C-type standard exists. This radiation emission may be functional for processing or may be undesirable. The issues of electromagnetic compatibility are not addressed in the standard. This part of ISO 13732 provides temperature threshold values for burns that occur when human skin is in contact with a hot solid surface. It also describes methods for the assessment of the risks of burning, when humans could or might touch hot surfaces with their unprotected skin. This part of ISO 13732 also gives guidance for cases where it is necessary to specify temperature limit values for hot surfaces; it does not set surface temperature limit values. This part of ISO 13732 deals with contact periods of 0,5 s and longer. It is applicable to contact when the surface temperature is essentially maintained during the contact (see 4.1). This part of ISO 13732 is applicable to the hot surfaces of all kind of objects: equipment, products, buildings, natural objects, etc. For the purposes of simplification, it mentions only products; nevertheless, it applies to all other objects as well.
